Program Description: Zenith Arc Advisory LLC operates an automated SMS notification and scheduling system. As a registered client, you will receive transactional messages including system calibration updates, End-of-Day booking reports, ROI audit notifications, and appointment reminders related to your account.

Message Frequency: Message frequency varies based on your account activity and project status. All messages are delivered between 8:00 AM and 9:00 PM in the recipient's local time zone in compliance with applicable TCPA guidelines.

Rates: Message and data rates may apply from your wireless carrier.

Opt-Out: You may cancel SMS communications at any time by replying STOP to any message. You will receive a single confirmation message, after which no further SMS messages will be sent.

Carrier Liability: Carriers are not liable for delayed or undelivered messages.

TO THE FULLEST EXTENT PERMITTED BY LAW, ZENITH ARC ADVISORY LLC SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, OR CONSEQUENTIAL LOSSES ARISING FROM USE OF OUR PLATFORM OR SERVICES. ZENITH ARC ADVISORY LLC IS NOT RESPONSIBLE FOR ANY TECHNICAL FAILURES, CARRIER-RELATED DELAYS, OR MESSAGE DELIVERY ISSUES CAUSED BY THIRD-PARTY PROVIDERS INCLUDING TWILIO AND WIRELESS CARRIERS.

9. Messaging Agent Terms

Zenith Arc Advisory LLC operates as an authorized SMS messaging service provider on behalf of registered business clients ("Client Businesses"). When acting in this capacity, Zenith Arc Advisory LLC sends automated SMS/MMS messages to the end-customers of those Client Businesses solely as directed by and under the authority of the Client Business. Zenith Arc Advisory LLC provisions a dedicated Twilio-based phone number for each Client Business and configures an IVR voicemail system on that number. Unanswered calls forwarded from the Client Business's phone system reach this Twilio number, where a Zenith Arc-recorded disclosure message plays. This disclosure informs the caller that one automated follow-up text message may be sent on behalf of the Client Business and that they may reply STOP to opt out. This voicemail recording is configured and maintained solely by Zenith Arc Advisory LLC and constitutes the IVR disclosure. Upon the caller ending the call, a single automated SMS is sent identifying the Client Business by name and requesting the caller's explicit consent to receive further communications. No further automated messages are sent until the recipient replies affirmatively. All automated messages identify the Client Business as the sender. Zenith Arc Advisory LLC maintains records of all opt-in timestamps, opt-out requests, and message logs. End-customers may opt out at any time by replying STOP. Opt-out requests are honored immediately.
